Please correct me if I am wrong…
The State Supreme Court has no legislative authority on matters such as this. Ok, they struck down Prop 22 as unconstitutional. There is still no law passed by the State Congress and signed by the Governor that explicitly allows gay marriage. Until there is such a law, gay marriage is not allowed in California.
Now, maybe I am wrong. Maybe the judiciary does have the right to enact legislation. If so, then I must have missed that part of State Government in school…
