    One of the problems that I see is that there is the assumption of discrimination. I am unaware of any public facility that denies a person access to a restroom corresponding to that persons biological gender. And that is the reason for such separation…not to separate based on ‘percieved gender’ but biological gender. A person may have hundreds of operations, but if a DNA test turns up the XY chromosome pair, that person is biologically male, and belongs in the restroom for men, period. Not that there isnt a religious argument; indeed, the religious argument trumps the DNA test. They both happen to come to the same conclusion.
